PATIENT ACKNOWLEDGMENT AND CONSENT RE: VIRTUAL CARE

Please do not access the Platform if you do not agree to this Acknowledgement and Consent.

In addition to any terms defined herein, the following terms shall have the following meanings:

"Acknowledgement and Consent" means this Patient Acknowledgement and Consent re: Virtual Care, as revised from time to time.

"Appendix" means the appendix to this Acknowledgement and Consent.

"CasaHealth" means CasaHealth Tech Inc. d.b.a. Pocketpills Health.

"Healthcare Professionals" means the regulated healthcare professional(s) who/that provide(s) the Healthcare Services to you.

"Healthcare Services" means, collectively, medical services, nursing services and pharmacy services, and "Healthcare Service" means any one of them as the context requires.

"Platform" means the platform developed by CasaHealth and available through: www.pocketpills.com, which connects users with Healthcare Professionals.

"Staff" means staff or contractors of the Healthcare Professionals.

"Virtual Healthcare Services" means the Healthcare Services when provided virtually through the Platform.

"We" or "us" means, collectively, CasaHealth, its affiliates, those persons who license the Pocketpills name and/or the Platform and the Healthcare Professionals, or any one of them as the context permits.

You acknowledge that either you or we may, at any time, withdraw the option of using the Virtual Healthcare Services upon providing written notice.

APPENDIX

Risks of Using Virtual Care - Generally and using the Platform

I acknowledge and understand that despite recommendations that encryption software be used as a security mechanism for virtual care tools, it is possible that the Virtual Healthcare Services may not be encrypted.

Despite this, I agree to the receipt of Virtual Healthcare Services with a full understanding of this risk.

We will use reasonable means to protect the security and confidentiality of information sent and received using the Platform and in the provision of the Virtual Healthcare Services. However, because of the risks outlined below, there can be no guarantee as to the security and confidentiality in the context of the Virtual Healthcare Services:

  • Use of virtual care tools to discuss sensitive information can increase the risk of such information being intercepted by third parties.
  • Despite reasonable efforts to protect the privacy and security of information communicated through virtual care platforms, it is not possible to completely secure the information.
  • Virtual care tools can introduce malware into a computer system, and potentially damage or disrupt the computer, networks, and security settings.
  • Communications through virtual care tools can be forwarded, intercepted, circulated, stored, or even changed without the knowledge or permission of the Healthcare Professional or you as the patient.
  • Even after the sender and recipient have deleted copies of electronic communications, back-up copies may exist on a computer system.
  • Communications through virtual care tools may be disclosed in accordance with a duty to report or a court order.
  • Some videoconferencing platforms may be more open to interception than other forms of videoconferencing.

If email or text is used as a virtual care tool, the following are additional risks:

  • Email, text messages, and instant messages can more easily be misdirected, resulting in increased risk of being received by unintended and unknown recipients.
  • Email, text messages, and instant messages can be easier to falsify than handwritten or signed hard copies. It is not feasible to verify the true identity of the sender, or to ensure that only the recipient can read the message once it has been sent.

Conditions of Using the Virtual Healthcare Services

  • While your Healthcare Professional will attempt to review and respond in a timely fashion to electronic communications such as emails, text messages, and instant messages, they cannot guarantee that all electronic communications will be reviewed and responded to within any specific period of time. The Virtual Healthcare Services must not be used for medical emergencies or other time-sensitive matters.
  • If your electronic communication requires or invites a response from your Healthcare Professional and you have not received a response within a reasonable time period, it is your responsibility to follow up to determine whether the intended recipient received the electronic communication and when the recipient will respond.
  • Virtual care is not always an appropriate substitute for in-person care. You are responsible for following up on your Healthcare Professional's electronic communication and for scheduling appointments with your primary care provider where warranted.
  • Electronic communications or recordings of Virtual Healthcare Services concerning diagnosis or treatment may be printed or transcribed in full and made part of your medical record.
  • Your Healthcare Professional may forward electronic communications or recordings to Staff and those involved in the delivery and administration of your care in accordance with applicable laws.
  • You agree to inform your Healthcare Professional of any types of information you do not want communicated via the Platform.
  • Your Healthcare Professional is not responsible for information loss due to technical failures associated with your software or internet service provider.

Instructions for using the Virtual Healthcare Services:

To use the Virtual Healthcare Services, you must:

  • reasonably limit or avoid using a third party's computer - e.g., an employer's computer;
  • conduct encounters with your Healthcare Professional in a private setting and using a secure device, where possible;
  • obtain your Healthcare Professional's consent prior to making any recording of any virtual care encounter; and
  • inform us of any changes in your email address, mobile phone number, or other account information necessary to receive the Virtual Healthcare Services.

If the Virtual Healthcare Services include email, instant messaging and/or text messaging, the following applies:

  • Review all electronic communications to ensure they are clear and that all relevant information is provided before sending to your Healthcare Professional.
  • Ensure your Healthcare Professional is aware when you receive an electronic communication from the Healthcare Professional, such as by a reply message.
  • Take precautions to preserve the confidentiality of electronic communications, such as using screen savers and safeguarding computer passwords.
  • Withdraw consent only by email or written communication to us. However, your withdrawal of consent will affect your ability to receive the Virtual Healthcare Services.
  • If you require immediate assistance, or if your condition appears serious or rapidly worsens, you should not rely on the Virtual Healthcare Services. Rather, in the case of an emergency, call 911 or attend the closest Emergency Department.

By proceeding to use the Platform to receive a Healthcare Service: you: (1) acknowledge that you have read and fully understand the risks and limitations of the provision and receipt of Healthcare Services virtually, generally, and through the Platform, more specifically, as detailed in the Acknowledgement and Consent, above, (2) agree to the receipt of Healthcare Services via the Platform and to communicate with the Healthcare Professionals and their Staff via the Platform or otherwise using electronic means, and (3) consent to the conditions and to follow the instructions outlined above and otherwise imposed by my Healthcare Professional from time to time.
